Customer alleges bar/restaurant's negligence caused him to fall on stairs

ORLANDO — An Orange County man is suing the owners of a Winter Park bar/restaurant, alleging negligence caused him to fall down a flight of stairs.

Karim Elkasimi filed a complaint April 9 in Orange County Circuit Court against Soho WP LLC , doing business as Boca Kitchen Bar & Market, BE-1 Concepts Holdings LLC and Sweetman Building LLP, alleging they failed to provide a safe environment for its business invitees.

According to the complaint, on Nov. 25, 2017, Elkasimi was on the second floor, near the stairway of the defendants' Boca Kitchern Bar & Market. The suit says he fell down approximately 20 stairs because of the defective, deficient and nonconforming design of the building. 

As a result of the defendants’ negligence, Elkasimi says, he suffered bodily injury including disability, mental anguish, inconvenience, loss of capacity for the enjoyment of life, aggravation of an existing condition, medical expenses and loss of earnings. 

The plaintiff alleges the defendants failed to maintain the stairway/ingress/egress, thus creating a trip or fall hazard, failed to provide staff, adequate security and/or safety precautions in the area, and failed to utilize contrasting colors to identify each stair tread.

Elkasimi seeks trial by jury, damages in excess of $15,000, plus costs, interest for damages previously liquidated and all other relief the court deems proper and just. He is represented by attorney Matt T. Morgan of Morgan & Morgan PA in Orlando.
