Hollywood couple alleges insurer failed to cover hurricane damage

FORT LAUDERDALE — A Hollywood couple is suing an insurance company, alleging breach of contract.

Jeffrey Hertzberg and Barbara Hertzberg filed a complaint April 10 in Broward Circuit Court against Southern Oak Insurance Company, alleging failure to cover property damages caused by a hurricane. 

According to the complaint, on Sept. 10, 2017, the Hertzbergs' insured dwelling at 3901 N. 36th Ave., Hollywood, suffered physical damages due to Hurricane Irma. The suit says the hurricane caused roof damage that resulted in an unexpected intrusion of water into the interior of the property. 

However, the Hertzbergs say, Southern Oak has refused to pay the full amount of damages. 

The plaintiffs allege Southern Oak Insurance has obligated the Hertzbergs to retain counsel to prosecute legal action, and breached the policy of insurance by failing to pay the full amount of damages.

The Hertzbergs seek trial by jury, damages of more than $15,000, court costs, attorney fees and all other relief the court deems just. They are represented by attorney Moshe Rubinstein of Moshe Rubinstein Law Firm PA in Hollywood.
