Sunrise homeowner alleges insurer refuses to cover wind damages

Insurance 08

FORT LAUDERDALE — A Sunrise homeowner is suing an insurance company, alleging breach of contract.

Jean Victor filed a complaint April 4 in Broward Circuit Court against Universal Property & Casualty Insurance Company, alleging failure to cover property damage caused by hurricane-force winds.

According to the complaint, on Sept. 10, 2017, Victor's home 2320 NW 81st Ave., Sunset suffered damages from a windstorm triggered by Hurricane Irma. The suit says Victor has been damaged due to Universal Property's breach of the insurance contract by not paying insurance proceeds to the plaintiff as a result of a covered loss.

The plaintiff alleges Universal Property & Casualty Insurance has failed to pay her entire insurance claim, and has obligated Victor to retain an attorney to bring legal action.

Victor seeks trial by jury, damages, interest and attorney fees. She is represented by attorneys Samuel Rogatinsky and E. Terrell Matthews of Rogatinsky & Matthews PA in Fort Lauderdale.
