CLEARWATER — A former city worker is suing Clearwater, alleging breach of contract and wrongful termination.
Stephen Talner filed a complaint April 6 in Pinellas Circuit Court against the city of Clearwater, alleging violation of his constitutional rights.
According to the complaint, Tainer worked November 2011 until Jan 4, 2018, on a part-time basis for Clearwater's Parks and Recreation Department. Tainer says he was fired due to what the city considered an improper relationship with a female city employee and alleged harassment.
Tanier alleges he has incurred economic and non-economic damages as a result of the wrongful deprivation of his constitutional rights to free speech and liberty by releasing a trespass notice without the procedural due process.
The plaintiff alleges the city of Clearwater failed to provide him any opportunity to challenge the suspension contained in the trespass notice, and took disciplinary action toward Tainer that constituted constructive termination of his employment.
Tainer seeks trial by jury, declaratory and injunctive relief, damages, plus court costs, interest and attorney fees and all further relief the court deems just. He is represented by attorney Stavros Tingirides of Clearwater.
