Orlando homeowner alleges insurer failed to cover water damage

ORLANDO — An Orlando homeowner is suing an insurance company, alleging breach of contract.

Wavell Munro filed a complaint April 3 in Orange County Circuit Court against Florida Peninsula Insurance Company alleging that the insurer breached its duty of good faith and fair dealing.

According to the complaint, on Nov. 5, 2015, Munro's home at 221 Wolf Road, Orlando, was damaged from an accidental discharge of water from a plumbing system. The suit says although Munro's property's policy was in full force and effect, Florida Peninsula has wholly and improperly denied coverage for his loss and claim. 

The plaintiff alleges Florida Peninsula Insurance has obligated Munro to engage legal counsel and has failed to timely and promptly pay the full amount due and owing under the policy.

Munro seeks trial by jury, declaratory relief of more than $15,000, attorney fees and court costs. He is represented by attorneys Harold Levy and Brian K. Lewis Jr. of HL Law Group PA in Fort Lauderdale.
