Crane rental company alleges customer failed to pay

ORLANDO — A crane rental company is suing an oil refining business, alleging breach of contract.

Maxim Crane Works LP filed a complaint April 2 in Orange County Circuit Court against Nexlube Tampa LLC, alleging the defendant failed to perform all obligations under the contract.

According to the complaint, Maxim Crane Works entered into an agreement by which it would rent customized rigging beams and stools for $8,400, plus tax, per month, to be used by the defendant for a project at the port of Tampa. Maxim Crane alleges its equipment is sitting under hundreds of tons of other equipment owned by defendant. 

Despite performing all conditions required under the contract, the suit says Maxim Crane's materials have not been returned and remains unpaid amounting to $8,954. The plaintiff alleges Nexlube Tampa has failed to pay for the rental of Maxim's equipment as well as failed to return the rented equipment.

Maxim Crane Works seeks trial by jury, damages in excess of $15,000, plus pre- and post-judgment interest, court costs and all other relief the court finds just and proper. It is represented by attorneys Brian P. Kirwin and April Rocke of Kirwin Norris PA in Orlando.
