Orlando homeowners allege insurer has failed to provide benefits to cover hurricane damage

Insurance 03

ORLANDO — Two Orlando property owners are suing an insurance company, alleging breach of an insurance contract.

Noel Santiago and Dorimar Castellano filed a complaint April 2 in Orange County Circuit Court against Security First Insurance Company, alleging the defendant has refused to the pay the full amount of a claim.

According to the complaint, on Sept. 11, 2017, Hurricane Irma caused a covered loss and substantial damage to the plaintiffs' property at 126 Cosmos Drive, Orlando. The suit says the property was covered under an insurance policy issued by Security First, a policy that, at the time of the loss, was in full force and effect.

Santiago and Castellano say they timely filed a notice of the loss to Security First and have otherwise performed all conditions precedent to recover under the policy. The lawsuit states despite the defendant receiving and processing the claims, Security First has refused and continues to refuse to pay the full amount of the claim.

The plaintiffs allege Security First Insurance has failed and refused to pay the full amount of the claim, contrary to the terms of the policy and contrary to Florida law.

Santiago and Castellano seek trial by jury, damages of more than $15,000, including damage to the premises, with costs, interest as allowed by law, reasonable attorney fees and all other relief the court deems just and proper. They are represented by attorney Ely R. Levy of Militzok & Levy PA in Hollywood, Florida.
