Homeowners dispute United Property & Casualty Insurance evaluation of Irma damages

ORLANDO – An Orange County couple is disputing their insurance company's evaluation of damages to the property from Hurricane Irma.

Luis Frias and Sobeyda Frias filed a complaint on April 2 in the 9th Judicial Circuit Court of Florida - Orange County against United Property & Casualty Insurance Co. alleging breach of contract.

According to the complaint, the plaintiffs allege that on Sept. 10, 2017, while their insurance policy with the defendant was in full force and effect, their property sustained damage as a result of Hurricane Irma. 

Although the defendant acknowledged that the property is covered under the policy, the plaintiffs claim the defendant refuses to provide the proper amount needed to the cover the loss. The plaintiffs allege the property has sustained greater damage than what the defendant acknowledged.

The plaintiffs hold United Property & Casualty Insurance Co. responsible because the defendant allegedly failed to acknowledge that payment would be forthcoming, failed to comply with the provisions of the subject insurance policy, including but not limited to adjusting the loss, and failed provide a statement detailing a justifiable reason for not providing payment.

The plaintiffs seek judgment for damages, prejudgment interest, attorney's fees, and costs. They are represented by Stephanie Balint and Robert L. Gioia of Homeowner Legal Solutions LP in Plantation.
