Customer alleges auction business' negligence caused injuries

CLEARWATER — A customer is suing a Pinellas Park auction business, alleging negligence led to injuries for the plaintiff.

Michael Tessone filed a complaint April 2 in Pinellas County Circuit Court against Bay Area Auction Services Inc., alleging the defendant failed to to maintain the premises in a reasonably safe condition.

According to the complaint, on Dec. 16, 2017, Tessone was at Bay Area Auction Services in Pinellas Park. The suit says Tessone exited down a ramp heading to the loading dock in order to load ceiling tiles that he purchased from the defendant when he was injured while using its pallet jack to load the tiles. 

As a result, Tessone says he sustained injuries, suffered pain and incurred medical expenses. 

The plaintiff alleges Bay Area Auction Services failed to allow invitees to utilize its functional and available loading dock to the load the ceiling titles and failed to warn of the unsafe condition on the premises.

Tessone seeks trial by jury, judgment in excess of $15,000, plus court costs and interest. He is represented by attorney Justin W. Pimenta of Abrahamson & Uiterwyk in Tampa.
