Employee alleges Winter Park assisted living facility violated FLSA

ORLANDO — An employee is suing a Winter Park assisted living facility, alleging violation of the Fair Labor Standards Act (FLSA).

Peggy Duhaney filed a complaint March 30 in Orange County Circuit Court against Faith House of Winter Park LLC, alleging failure to pay employees for all hours worked.

According to the complaint, from December 2015 to November 2017, Duhaney worked for Faith House as a caregiver. The suit says Duhaney has suffered the loss of earnings for working additional hours in excess of 40 per week, but not being compensated at the statutory rate of one and a half her regular rate of pay as required by FLSA. 

The plaintiff alleges Faith House of Winter Park failed to pay her an overtime premium for all overtime hours worked and showed reckless disregard of the provisions of the FLSA.

Duhaney seeks trial by jury, unpaid back wages, minimum wage and liquidated damages, declaratory relief, court costs, attorney fees and all relief the court deems just. She is represented by attorney Christopher J. Saba of Wenzel Fenton Cabassa PA in Tampa.
