Passenger blames bus company for injuries

ORLANDO — A passenger is suing a bus company, alleging negligence led to injuries for the plaintiff.

Wendy Westmoreland filed a complaint March 30 in Orange County Circuit Court against Bus USA Inc., alleging failure to provide a safe and secure environment.

According to the complaint, on April 10, 2015, Westmoreland was a passenger on the defendant’s bus when she suffered injuries as she slipped and fell at the Florida Mall in Orlando as she was exiting the bus due to its deteriorated condition.  

As a result of the incident, Westmoreland says she sustained injuries in and about her body and extremities, resulting in pain and suffering, disability, mental anguish, medical expenses, loss of earnings, and/or aggravation of a previous existing condition. 

The plaintiff alleges Bus USA failed to adequately maintain and inspect the bus for a wet floor and damaged steps, and failed to warn her of the dangerous condition of the bus.

Westmoreland seeks trial by jury, damages in excess of $15,000, exclusive of interest, court costs and attorney fees and all other relief the court deems just. She is represented by attorneys Carolyn M. Salzmann and Billie Jo Belcher of Legally Pink Law PLLC in Winter Park.
