Orlando homeowner alleges insurance company failed to provide proper compensation

ORLANDO — An Orlando property owner is suing an insurance company, alleging breach of contract.

Yaritza Rivera filed a complaint March 26 in Orange County Circuit Court against Universal Property & Casualty Insurance Company, alleging failure to pay for the damages to the insured property.

According to the complaint, on Oct. 7, 2016, her property at 11436 Bentry St., Orlando, suffered a direct physical loss due to Hurricane Matthew, , mainly affecting the roof. The suit says Universal Property did acknowledge coverage for the loss and investigated the claim, including inspecting the property and estimating the damage., However, Rivera says, the defendant rejected the total amount of damages and tendered a payment lower than the required amount. 

The plaintiff alleges Universal Property & Casualty Insurance refuses to honor its contractual obligation to pay correct amount for the covered loss.

Rivera seeks trial by jury, compensation damages of more than $15,000, plus court costs, prejudgment interest, and attorneyfees. She is represented by attorneys Hunter Patterson and Alicia Perez of Strems Law Firm in Winter Park.
