Orlando homeowner alleges insurance carrier failed to cover hurricane damage

ORLANDO — An Orlando property owner is suing an insurance company, alleging breach of contract.

Lee Chira filed a complaint March 26 in Orange County Circuit Court against Pacific Indemnity Company alleging failure to provide cover for hurricane damage. 

According to the complaint, on Sept. 10, 2017, Chira sustained economic damages, including damaged property and repair costs when his property at 9216 Bay Point Drive, Orlando, was substantially damaged by wind from Hurricane Irma while the insurance policy was in full force and effect. However, the suit says, Pacific Indemnity has refused to pay for all the plaintiff's losses, despite his compliance with all conditions precedent to recovering damages under the policy. 

The plaintiff alleges Pacific Indemnity has breached the insurance contract by refusing to pay for all of Chira's losses, and obligated him to pay for attorney services in bringing legal action.

Chira seeks trial by jury, judgment for all covered losses of more than $15,000, plus interest, attorney fees and court costs. He is represented by attorney Mark A. Nation of The Nation Law Firm in Longwood.
