CLEARWATER – A Bay County corporation is alleged to have failed to return a deposit made on a boat after the buyer backed out of the sale.
Guy K. Kunnen, as trustee of the Stephen James Spencer Trust, GST Trust filed a complaint on March 27 in the 6th Judicial Circuit Court of Pinellas County against Glasstream Inc. alleging conversion and violation of Florida's Civil Theft Statute.
According to the complaint, the plaintiff discussed the purchase of a boat with the defendant and wired $25,000 in November 2016 to the defendant. The suit states the plaintiff never entered into a written or oral contract for the boat's purchase. The plaintiff alleges he later decided not to purchase the boat and that his deposit has not been returned.
The plaintiff holds Glasstream Inc. responsible because the defendant allegedly failed and refused to return the amount deposited by the plaintiff and deprived the plaintiff of possession or use of the funds and the right or benefit from the property.
The plaintiff seeks judgment against defendant for an amount within the jurisdictional limits of the court, including an award of interest, attorneys’ fees and costs. He is represented by Joel S. Treuhaft of Palm Harbor Law Group PA in Palm Harbor.
