Customer blames Seminole Mall owners for injuries

CLEARWATER — A Pinellas County woman is suing owners of the Seminole Mall, alleging negligence led to injuries for the plaintiff.

Gay Vary filed a complaint March 27 in Pinellas Circuit Court against North American Development Group LLLP, doing business as Seminole Mall LP, and The TJX Companies Inc, doing business Homegoods Inc., alleging failure to exercise reasonable care for safety to business visitors/invitees.

According to the complaint, Feb. 17, 2017, Vary went to the defendants' shopping center at 7893 113th St., Seminole. The suit says Vary tripped while attempting to walk on the sidewalk across the curb ramp. She says the fall led to injuries, medical expenses, hospitalization and the ability of Vary to enjoy a normal life. 

The plaintiff alleges the defendants failed to inspect or adequately inspect the curb ramp to determine whether the ramp was in a reasonably safe condition for the safety of customers.

Vary seeks trial by jury, damages in excess of $15,000, plus interest, court costs and attorney fees. She is represented by attorney Michael C. Bird of Morgan & Morgan Tampa PA in Tampa.
