Treasure Island homeowners allege insurer failed to cover property loss

CLEARWATER — Two Treasure Island property owners are suing insurance companies, alleging breach of contract.

Casey and Michelle Messer filed a complaint March 27 in Pinellas County Circuit Court against the Lexington Insurance Company and QBE Specialty Insurance Company, alleging the defendants refused to honor their flood policy, the all-risk policy and Florida law.

According to the complaint, on Sept. 20, 2017, the Messers reported property loss to the defendants after sustaining wind damage at 11905 Sixth St. E., Treasure Island. The suit says the Messers maintained three insurance policies covering the property and have performed all conditions required under each policy but the defendants refuse to provide benefits to restore the property to its pre-loss condition. 

The plaintiffs allege Lexington Insurance Company and QBE Specialty Insurance Company have failed to pay the benefits to which the insured are entitled for the loss.

The Messers seek trial by jury, damages of more than $15,000, prejudgment interest, court costs, expert fees, attorney fees and all other the court deems just and reasonable. They are represented by attorneys Amy D. Boggs and D. Scott Boggs of The Law Office of Amy Boggs, PA in St. Petersburg.
