CLEARWATER — A Pinellas County man is suing motorists and Allstate, alleging negligence and breach of contract.
Gerard A. Sherwin filed a complaint March 16 in Pinellas County Circuit Court against Thomas Holdstein, Derek Bradshaw and Allstate Fire and Casualty Insurance Company, alleging Holstein and Bradshaw caused a collision with the plaintiff's vehicle, resulting in injuries but Allstate refuses to provide any compensation.
According to the complaint, on Sept. 6, 2017, Sherwin was driving at the intersection of Park Boulevard and Belcher Road in Pinellas Park. The suit says Sherwin was run into by cars driven by Holdstein an Bradshaw. Sherwin says he was entitled to receive benefits from Allstate for uninsured motorist claims but he has failed to receive any coverage.
The lawsuit states Sherwin suffered injuries, disability, mental anguish and hospitalization.
The plaintiff alleges Allstate has failed to perform its obligations in accordance with the provisions of Florida law to pay uninsured motorist benefits under the policy.
Sherwin seeks trial by jury, damages in excess of $15,000, plus interest and court costs, and all further relief the court deems just and proper. He is represented by attorney Matthew T. Rice of Rice Law Group PA in South Pasadena.
