Guest blames Disney hotel for room injuries

ORLANDO — A guest is suing a Walt Disney hotel operator, alleging negligence after a ceiling fan fell on the plaintiff.

Philip Bergsieker filed a complaint March 19 in Orange County Circuit Court against Walt Disney Parks and Resorts U.S. Inc., alleging the hotel operator failed to maintain its premises in a safe condition.

According to the complaint, on Aug. 31, 2015, Bergseiker was a guest at Walt Disney World's Old Key West Hotel. The suit says he tried to adjust the speed of the ceiling fan in room but the fan and light fell and struck him.

Bergsieker says he sustained bodily injury and resulting pain and suffering, disability, and loss of earnings as a result of Disney's carelessness in allowing a defective fan and light to remain in the guest room. . 

The plaintiff alleges Walt Disney Parks and Resorts failed to warn him of the hazardous fixture in his room and allowed the fan to fall into disrepair.

Bergsieker seeks trial by jury and damages in excess of $15, 000. He is represented by attorney David R. Heil of Winter Park.
