Customer blames Publix for injuries

ORLANDO — An Orange County woman is suing Publix, alleging negligence led to injuries for the plaintiff.

Barbara Tolbert filed a complaint March 14 in Orange County Circuit Court against Publix Super Markets Inc., alleging the retail store failed to use due care to maintain its premises in a safe condition.

According to the complaint, on Dec. 7, 2017, while Tolbert was shopping at the Publix, 409 S. Chickasaw Trail, Orlando, she slipped on a liquid substance on the floor The suit says Tolbert sustained bodily injuries, resulting in pain and suffering, disability, disfigurement, mental anguish, loss of capacity for the enjoyment of life, and she incurred medical expenses. 

The plaintiff alleges Publix Super Markets failed to maintain the floor in a safe condition, failed to post or display warning signs indicating the slippery floor and failed to adequately supervise employees on the procedures for inspecting and cleaning the floors.

Tolbert seeks trial by jury, damages of more than $15,000, court costs and interest, plus all other relief the court deems just. She is represented by attorneys Andrew F. Knopf and Joshua Wright of Paul / Knopf / Bigger in Winter Park.
