CLEARWATER — A Pinellas County man is suing owners of a Pinellas Park Kentucky Fried Chicken restaurant, alleging negligence led to injuries for the plaintiff.
Gary G. Ponte filed a complaint March 13 in the Pinellas Circuit Court against FQSR LLC, doing business as KBP Foods, alleging failure to maintain its premises in a safe condition.
According to the complaint, on Sept. 6, 2016, Ponte was on the defendant's premises to eat at a Kentucky Fried Chicken, 6595 Park Boulevard. Pinellas Park. The suit says Ponte slipped on a substance near one of the restrooms that appeared to be water. Ponte says this caused him to fall and sustain injuries, incur medical expenses for the treatment of his injuries, sustain pain and suffering of both physical and mental nature, permanent injuries and loss of wages.
The plaintiff alleges KBP Foods failed to adequately warn him of the danger of slipping on the substance, and failed to adequately inspect and maintain the floor space in and around the restroom hallway.
Ponte seeks trial by jury, damages in excess of $15,000, exclusive of interest, court costs and attorney fees. He is represented by attorney Brock H. Johnson of Morgan & Morgan Tampa PA in Tampa.
