Motorist alleges State Farm failed to provide crash coverage

Car accident 13

FORT LAUDERDALE — A Broward County woman is suing a motorist and insurance company, alleging negligence and breach of contract.

Jennifer Betin filed a complaint March 8 in Broward County Circuit Court against Andrea A. Onel, and State Farm Mutual Automobile Insurance Company, alleging failure to provide uninsured/uninsured motorist coverage for losses and damages sustained by a vehicle crash victim.

According to the complaint,on March 18, 2014, Betin was driving her 2005 Dodge Caravan near the intersection of Federal Highway and Van Buren Street in Hollywood, Florida. The suit says Betin's vehicle was negligently struck by Onel's vehicle when Onel failed to stop for a red light.

As a result, Betin says she was injured and became entitled to insurance benefits under uninsured/underinsured motorist provision policy. However, the suit says, Betin has failed to recover any compensation from State Farm.

The plaintiff alleges State Farm Mutual Automobile Insurance failed its contractual duty pursuant to the insurance policy to pay benefits for damages sustained after a vehicular accident.

Betin seeks trial by jury, compensatory damages in excess of $15,000, plus court costs. She is represented by attorney Howard N. Galbut of Miami.
