Margate property owner alleges insurer failed to pay for hurricane damage

FORT LAUDERDALE — A Margate property owner is suing an insurance company, alleging breach of contract.

Max Gerald Jean filed a complaint March 9 in Broward Circuit Court against Heritage Property & Casualty Insurance Company, alleging failure to pay for hurricane damage.

According to the complaint, on Sept. 17, 2017, Jean's home at 2200 NW 69th Terrace, Margate, suffered damages a result of water, wind and storm damage from Hurricane Irma. Although Jean says he gave timely notice of the loss, Heritage Property has refused to pay the full value of the claim. 

The plaintiff alleges Heritage Property & Casualty Insurance has failed to fully and properly investigate and adjust the claim, and refused to acknowledge all applicable coverage and indemnify the plaintiff.

Jean seeks trial by jury, general damages of more than $15,000, attorney fees, costs of litigation, interest, and all other relief the court deems just. He is represented by attorney Linda M. Knoerr of Law Office of Linda M. Knoerr in Coral Springs.
