Apopka homeowner alleges Insurance firm failed to cover claim

ORLANDO — An Apopka property owner is suing an insurance company, alleging breach of an insurance contract.

Kristi Vik filed a complaint March 1 in Orange County Circuit Court against Avatar Property & Casualty Insurance Company, alleging the defendant failed to fully compensate the plaintiff for all losses covered under the subject policy.

According to the complaint, on Nov. 22, 2017, Vik's insured dwelling at 2025 Cranberry Way Isles Way, Orlando, sustained water damage due to a sudden and unexpected broken pipe in the kitchen. 

Vik says she provided timely notice of the loss and has performed her obligation required under the agreed contract but has failed to receive any insurance coverage to compensate for the damages. 

The plaintiff alleges Avatar Property & Casualty Insurance made an unreasonable delay in properly evaluating the full damages, and has failed and refused to make full and proper payment of insurance proceeds.

Vik seeks trial by jury, damages of more than $15,000 caused by breach of policy, plus court costs, prejudgment interest and reasonable attorney fees. She is represented by attorney David Low of David Low & Associates PA in Fort Lauderdale.
