Parkland homeowner alleges insurer failed to cover hurricane damage

FORT LAUDERDALE — A Parkland man is suing an insurance company, alleging breach of contract.

Darnell Mack filed a complaint on March 9 in Broward Circuit Court against Tower Hill Signature Insurance Company, alleging the insurer failed to cover damages from a hurricane. 

According to the complaint, on Sept. 10, 2017, while Mack's property at 11045 NW 71st Court, Parkland, was insured by Tower Hill, it sustained a covered loss from Hurricane Irma. The suit says the damage required necessary repairs and replacements, cleaning and other remedial measures totaling $255,839.66, after the deductible and partial payment from the insurer. However, the lawsuit says, despite Mack's efforts to furnish timely notice of covered losses, the defendant has refused to pay all of plaintiff's claim. 

The plaintiff alleges Tower Hill Signature Insurance has failed to establish proof that it was not responsible for the payment of covered losses, and failed to pay the requested amounts for repairs and/or replacements.

Mack seeks trial by jury, insurance benefits of $255,839.66, attorney fees, legal assistant fees, interest, statutory penalties and court costs. He is represented by attorney Avraham A. Spivak of Spivak / Diez Litigation Attorneys PA in North Miami Beach.
