2 tenants accuse Orlando mobile home park owners of retaliation

ORLANDO — Two tenants are suing Orlando mobile home park owners, alleging retaliation.

Magda Ivette Torres and Elliot Hernandez filed a complaint March 1 in Orange County Circuit Court against Magnolia Lease Holding LLC, Magnolia Estate Mobile Home Park and Clint Horne, alleging violation of the Florida Civil Rights Act and the Florida Fair Housing Act.

According to the complaint, on May 17, 2017, Torres and Hernandez suffered mental anguish, loss of dignity, and other intangible injuries for being subjected to discrimination against their race. The suit says they were evicted from their rental home as retaliation for the defendants being forced to fix the inhabitable condition of the plaintiffs' property at 5436 Denise Ave., Orlando. 

The plaintiffs allege the defendants failed to ensure compliance with the non-discriminatory provisions of Florida law, refused to negotiate for the rental of a dwelling because of race and failed to properly maintain the rental property in a habitable condition.

Torres and Hernandez seek trial by jury, damages of more than $15,000, injunctive relief, court costs, attorney fees, interest, and all other relief the court deems just. They are represented by attorney Jose F. Garcia of J. Garcia Law Firm PA in Orlando.
