Property owners sue insurance company they say failed to pay benefits

ORLANDO — Property owners are suing American Integrity Insurance Company, an insurance carrier, citing alleged breach of contract.

Maura and Michael Caruso filed a complaint March 1 in the Orange Circuit Court against American Integrity Insurance Company, alleging that the insurance carrier breached its duty of good faith and fair dealing.

According to the complaint, the plaintiffs allege that Maura and Michael Caruso lost the full value and benefit of their insured property and continue to suffer such loss as a result of the covered damage to their property and defendant's breached of the insurance contract by failing to pay all benefits due. 

The plaintiffs hold American Integrity Insurance Company responsible because it allegedly refused to properly investigate the loss, refused to tender all insurance proceeds due and owing to the plaintiffs and obligated them to retain attorneys for the prosecution of the action.

The plaintiffs request a trial by jury and seek judgment against defendant, award of compensatory and contractual damages, pre-judgment interest, costs of action, attorneys’ fees and such further relief as the Court may deem appropriate.
