Guest blames Orlando property owners for gunshot wounds

ORLANDO — An Orange County man is suing Orlando property operators, alleging negligence and strict liability in a criminal assault.

Marlon Britten filed a complaint March 1 in Orange Circuit Court against 5402 Pine Chase LLC and Avesta Homes LLC, alleging they failed to provide a safe premises to its invitees and tenants.

According to the complaint, on June 15, 2014, Britten was at the Avesta Rolling Hills Apartments. 5402 Pine Chase Drive, Orlando. The suit says Britten was violently shot and severely injured by a criminal assailant.

The lawsuit states the gunshot wounds caused Britten to sustain bodily injuries and resulting pain and suffering, disability, disfigurement, aggravation of a pre-existing condition, mental anguish, loss of capacity for the enjoyment of life, medical expenses and loss of earnings. 

The plaintiff alleges 5402 Pine Chase and Avesta Homes failed to prevent the criminal attack, failed to monitor the effectiveness and sufficiency of its security plan, and failed to hire and retain appropriately trained security guards.

Britten seeks trial by jury, damages that exceed $15,000, with interest and costs, plus any further relief the court deems proper. He is represented by attorney Tyrone A. King of King & Markman PA in Orlando.
