St. Petersburg property owner alleges insurer failed to cover fire damage

ORLANDO — A St. Petersburg property owner is suing an insurance company, alleging breach of contract.

Zachery Kilgore filed a complaint Feb. 26 in Pinellas County Circuit Court against Florida Peninsula Insurance Company,  alleging failure to pay the full amount owed in connection with a claim.

According to the complaint, on Sept. 7, 2017, Kilgore's property at 4700 Coquina Key Drive SE, Apartment C, St. Petersburg, suffered damages from a fire. The suit says Kilgore promptly notified Florida Peninsula of all damage sustained on his property due to the fire. 

Kilgore says the defendant extended partial coverage and made partial payments in connection with the claim but has not paid all amounts due under the contract despite Kilgroe performing all obligations required. 

The plaintiff alleges Florida Peninsula Insurance has failed to pay all amounts owned in connection with the claim, causing Kilgore to doubt his rights to receive additional insurance proceeds.

Kilgore seeks trial by jury, damages of more than $15,000, declaratory judgment declaring his rights to receive additional funds, court costs, attorney fees and all other relief the court deems just and appropriate. He is represented by attorney Stephen A. Messer of Molhem & Fraley PA in Tampa.
