Legal guardian accuses Tarpon Springs neighbor of sexual assault

CLEARWATER — A legal guardian is suing a Tarpon Springs neighbor, alleging battery and negligence.

Frances Plummer, as legal guardian for Nicole Plummer, filed a complaint Feb. 26, in Pinellas Circuit Court against James Grimm, alleging the defendant sexually assaulted Nicole Plummer. 

According to the complaint, Nicole Plummer, who lives at 1307 Belcher Drive, Tarpon Springs, suffers from disability and the inability to meet health and safety requirements. The suit says Grimm, 81, lives nearby at at 1310 Belcher and is mentally deranged.

The lawsuit states in December 2017, Grimm performed sexual acts on Nicole Plummer, both at her residence and at his. The suit alleges Plummer suffered injuries, mental anguish and aggravation of a pre-existing condition as a result of Grimm's sexual acts. 

The plaintiff alleges Grimm committed sexual acts upon a mentally disabled individual.

Frances Plummer seeks trial by jury, damages of more than $15,000 and costs of suit. She is represented by attorney James W. Holliday of Holliday Karatinos Law Firm PLLC in Lutz.
