Policy holder alleges State Farm fails to fully cover car crash injuries

CLEARWATER — A Pinellas County woman is suing State Farm, alleging breach of contract.

Maria Fudge filed a complaint Feb. 26 in Pinellas Circuit Court against State Farm Mutual Automobile Insurance Company alleging failure to fully cover injuries from a vehicle crash. 

According to the complaint, on June 17, 2017, Fudge was driving southbound on Interstate Highway 75 in Sarasota County when she was run into by a car driven by Orlan Morales, an uninsured motorist. The suit says Fudge was injured in and about her neck, back, body, and limbs, and has sustained scarring, mental anguish, loss of earning capacity and aggravation of a pre-existing condition.

The lawsuit states State Farm has denied full payments of benefits from Fudge's involvement in a motor vehicle accident inflicted by an uninsured motorist. 

The plaintiff alleges State Farm Mutual Automobile Insurance failed to fulfill its obligations under the agreement, by failing to fully pay the required uninsured motorist benefits.

Fudge seeks trial by jury, damages of more than $15,000, plus court costs and interest on all liquidated damages. She is represented by attorneys George Alan Tripp Jr. and Ian Matthew Thomas of Tripp Law Firm PA in Seminole.
