Woman sues insurance company she says did not pay covered losses

ORLANDO — A property owner is suing an insurance company, citing alleged breach of contract.

Aileen Sosa Cruz filed a complaint on Feb. 26 in the 9th Judicial Circuit Court of Florida-Orange County against People's Trust Insurance Company alleging that the defendant breached the insurance contract by refusing to perform its obligations required under the contract.

According to the complaint, Cruz alleges that on Oct. 7, 2016, she notified the defendant of the damages suffered to her insured property. Plaintiff claims she complied with all conditions precedent to entitle her to recover under the policy but failed to receive any compensation or be fully paid for all losses as required by the insurance policy. 

The plaintiff holds People's Trust Insurance Company responsible because it allegedly failed or refused to fully perform under the policy, to reimburse the full value of insured losses and to fully repair and/or pay for all of losses as required by the insurance policy.

The plaintiff requests a trial by jury and seeks judgment for all losses with interest on any overdue payments, attorney's fees and costs. She is represented by James D. Dye of Morgan & Morgan, PA in Orlando.
