Couple blames Disney amusement park for wife's injuries

ORLANDO — A Broward County couple is suing Walt Disney, alleging loss of consortium and negligence.

Hilda M. James and Dean James filed a complaint Feb. 26 in Orange County Circuit Court against Walt Disney Parks and Resorts, alleging the amusement park failed to to maintain its premises in a safe condition.

According to the complaint, on Oct. 24, 2015, Hilda James was on the defendant's premises when a chair she was sitting in suddenly collapsed. As a result of the negligence of the defendant, the suit says, James fell and sustained severe injuries, physical and mental pain and suffering, disability, mental anguish, inconvenience, loss of earnings and permanent aggravation of a pre-existing condition.

The suit says James further incurred hospital and medical bill. while Dean James, suffered and will suffer diminishment of his wife’s society, companionship, support, services and consortium. 

The plaintiffs allege Walt Disney Parks and Resorts failed to warn Hilda James of the dangerous condition, failed to remove the defective chair, and failed to correct the hazardous condition on the premises.

The Jameses seek trial by jury, damages of at least $15,000, court costs and interest, plus whatever other relief the court deems just. They are represented by attorney Jessica J. Gonzalez-Monge of Rubenstein Law PA in Orlando.
