Customer alleges classic car company wrongfully sold vehicle at lower price

ORLANDO — A car enthusiast is suing a classic car company, alleging breach of contract and unjust enrichment.

Charlie Ruth filed a complaint Feb. 15 in Orange County Circuit Court against Just Toys Classic Cars LLC alleging, the defendant failed to to sell a 1968 Mustang for the contracted amount.

According to the complaint, on Sept. 23, 2015, Ruth entered into a contract for Just Toys Classic Cars to have exclusive right to sell his 1968 Mustang on consignment for the minimum sale of $55,000. 

The suit says on May 28, 2017, Just Toys sold the vehicle without Ruth's consent for a reduced price of $32,000. Ruth says the defendant has not the returned the vehicle or any amount of the sale proceeds despite the plaintiff's demands. 

The plaintiff alleges Just Toys Classic Cars failed to sell the vehicle for the contracted amount and failed to pay the sale proceeds after completion of the sale.

Ruth seeks trial by jury, judgment for damages sustained, attorney fees, court costs and all other relief the court deems proper. He is represented by attorney Michael L. Dear of The Law Offices of Michael L. Dear, PLLC in Orlando.
