3 Orlando homeowners allege construction company violated building codes

ORLANDO — Three Orlando homeowners are suing a Tennessee construction corporation, alleging breach of contract and design defect.

Teresa Macedo-Mel, Augusto C. Mel and Luana da Cunha Macede Marques filed a complaint Feb. 16 in Orange County Circuit Court against Beazer Homes Corp., formerly of Tennessee, alleging the defendant violated requirements of the Florida Building Code in constructing a home.

According to the complaint, Beazer agreed to construct the plaintiffs' home at 12941 Sawgrass Pine Circle, Orlando, in accordance with the requirements of the Florida Building Code. However, the plaintiffs allege, the constructed home contains an improperly installed stucco system and defects that are not readily recognizable to homeowners who lack special knowledge or training. 

The plaintiffs allege Beazer Homes failed to comply with all applicable local, state, and national building codes and regulations, including The Florida Building Code, in contravention of the Florida Building Codes Act.

The plaintiffs seek trial by jury, damages of more than $15,000, plus interest, court costs and all other relief the court deems just and appropriate. They are represented by attorney Matthew L. Wilson of Burnett Wilson Reeder in Tampa.
