Orlando homeowner accuses builder of construction defects

ORLANDO — An Orlando homeowner is suing a Tennessee construction corporation, alleging breach of contract.

Rayan Garib filed a complaint Feb. 16 in Orange County Circuit Court against Beazer Homes Corp., formerly of Tennessee, alleging the defendant violated the requirements of Florida Building Code in constructing the home.

According to the complaint, Garib entered into a contract with Beazer Homes to construct a home at 1802 Plantation Oaks Drive, Orlando. The suit says that also part of the agreement was that the defendant would build the home pursuant to all applicable Florida Building Code provisions. 

Garib says he discovered the stucco system was inadequately and improperly installed. The suit says such defects are not readily recognizable, requiring special knowledge or training to ascertain and determine the nature and cases of the defects. 

The plaintiff alleges Beazer Homes failed to comply with all applicable local, state, and national building codes and regulations, including, but not limited to The Florida Building Code, in contravention of the Florida Building Codes Act.

Garib seeks trial by jury, damages of at least $15,000, plus interest, court costs and all other relief the court deems just and appropriate. He is represented by attorney Matthew L. Wilson of Burnett Wilson Reeder in Tampa.
