ORLANDO — An Orlando homeowner is suing an insurer, alleging breach of contract.
Cesar Matos filed a complaint Feb. 15 in Orange County Circuit Court against Homeowners Choice Property & Casualty Insurance Company, alleging failure to cover storm damages.
According to the complaint, on July 27, 2017, while Matos' property at 4949 Atwood Drive, Orlando, was insured under a homeowners insurance policy, it sustained a covered loss from storm damage. The suit says there was damage to the dwelling, other structures and personal property, resulting in the loss of use. However, Matos says despite his efforts to file all necessary forms and perform all obligations precedent to recover, Homeowners Choice has breached the policy by denying the plaintiff's claim.
The plaintiff alleges Homeowners Choice Property & Casualty Insurance has failed to comply with the terms of the insurance policy, obligated Matos to retain and pay for legal counsel to represent and protect his interest, and refused to pay the full amount of the plaintiff's insurance claim.
Matos seeks trial by jury, damages in excess of $15,000, plus interest, court costs, and attorney fees. He is represented by attorney David R. Heil of Winter Park.
