Property owners sue Insurance company, allege failure to indemnify

ORLANDO — Property owners are suing an insurance company, citing alleged breach of contract.

Autumn Stevens and David Stevens filed a complaint on Feb. 8 in the 9th Judicial Circuit Court of Florida-Orange County against Security First Insurance Company d/b/a Security First Florida alleging that it failed to properly indemnify them for loss that was sustained at their property.

According to the complaint, the plaintiffs allege that on Sept. 10, 2017, they sustained wind damage to their dwelling and personal property. They notified the defendant of the loss and complied with all conditions under the policy but claim they failed to be reimbursed. 

The plaintiffs holds Security First Insurance Company d/b/a Security First Florida responsible because it allegedly failed to indemnify them for the reasonable value to restore the insured property to its pre-loss condition and failed to comply with the obligations and duties required by the plantiffs'insurance policy.

The plaintiffs request a trial by jury and seek judgment for all monies outstanding, plus interest on any repairs necessary to place the subject dwelling in its pre-loss condition, plus attorney’s fees and costs. They are represented by Jonathan R. de Armas, Kimberly P. Simoes and Julio David Davila of Simoes Davila, PLLC in Longwood.
