ORLANDO — An Orlando property owner is suing an insurance company, alleging breach of contract.
Sohodrah Singh filed a complaint Feb. 8 in Orange County Circuit Court against Avatar Property & Casualty Insurance Company, alleging the defendant failed to fully compensate the plaintiff for all losses covered under the policy after a hurricane.
According to the complaint, on Sept. 10, 2017, Singh's insured property at 7307 Habbersham Drive, Orlando suffered direct, physical damages as a result of Hurricane Irma. The suit says Irma caused damage to the roof, resulting in the sudden and unexpected intrusion of water to the interior of the property.
Singh says she provided timely notice of the loss and made a claim to Avatar Property, seeking payment for the dwelling damages but she has suffered an unreasonable delay in evaluating the full damages of property.
The plaintiff alleges Avatar Property & Casualty Insurance has breached the policy by its unreasonable delay in properly evaluating the full damages and has failed or refused to make full and proper payment of the insurance proceeds.
Singh seeks trial by jury, damages of more than $15,000, plus court costs, prejudgment interest, and reasonable attorney fees. She is represented by attorney David Low of David Low & Associates PA in Fort Lauderdale.
