Insurance company allegedly failed to pay claim

ORLANDO — Property owners are suing an insurance company, citing alleged breach of contract.

Deonarine Bishundat and Himwattie Bishundat filed a complaint on Feb. 8 in the 9th Judicial Circuit Court of Florida-Orange County against American Integrity Insurance Company of Florida alleging that the defendant breached the contract of insurance by refusing to pay benefits necessary for repair of their property.

According to the complaint, the plaintiffs allege that on Aug. 15, 2017, they sustained property damage as a result of sudden and accidental wind and water damage. Plaintiffs claim they timely notified defendant of the loss and otherwise performed all conditions precedent to entitle them to coverage, but has not received any benefits necessary to repair the home, replace damaged contents or provide alternative accommodations while the home is not fit to live in. 

The plaintiffs holds American Integrity Insurance Company of Florida responsible because the defendant allegedly failed and refused to pay insurance benefits to repair the property loss that was agreed upon in the insurance policy.

The plaintiffs request a trial by jury and seek judgment for structural damages, contents, loss of use, attorney's fees, costs and whatever other relief the court deems appropriate. They are represented by Hans Kennon of Morgan & Morgan, PA in Orlando.
