Orlando homeowner alleges insurer failed to cover hurricane damage

Insurance 06

ORLANDO — An Orlando homeowner is suing an insurer, alleging breach of contract.

Quyen Van filed a complaint Feb. 8 in Orange County Circuit Court against St. Johns Insurance Company, alleging the insurer failed to pay for hurricane damage.

According to the complaint, on Sept. 10, 2017, while Van's property insurance was in full force and effect, his home at 8944 Tuscan Place, Orlando, sustained a covered loss as a result of Hurricane Irma. However, the suit says, despite Van's efforts to furnish timely notice of the covered loss, St. Johns has refused to pay the plaintiff's insurance claim.

The plaintiff alleges St. Johns Insurance has obligated Van to retain and pay for the services of a legal counsel to represent and protect his interest, and refuses to pay the full amount of the plaintiff's insurance claim.

Van seeks trial by jury, damages of more than $15,000, interest, court costs and attorney fees. He is represented by attorney David R. Heil of Winter Park.
