Tampa condo residents blame property owners for fire damage

CLEARWATER — Two Tampa condominium residents are suing the condo property owners, alleging negligence caused fire damages to the plaintiffs' property.

Carlo Schiappa and Olga Castro filed a complaint Feb. 7 in Pinellas Circuit Court against The Highlands at Hunter's Green Condominium Association Inc., alleging failure to follow applicable safety guidelines and regulations.

According to the complaint, on Oct. 5, 2016, Schiappa and Castro sustained damages to their personal property and belongings in Unit 415, 9481 Highland Oaks Drive, Tampa, when a cooking grill of their neighboring unit caught fire. The suit says the fire was a result of the carelessness of the defendants in permitting cooking grills on the premises, against its own rules and bylaws. 

The plaintiffs allege The Highlands at Hunter's Green Condominium Association failed to enforce its rules and regulations by permitting cooking grills on the premises, failed to provide a fire sprinkler system, and failed to comply with fire codes and/or state and local safety codes and/or regulations.

Schiappa and Castro seek trial by jury, damages in excess of $15,000, exclusive of costs and interest. They are represented by attorney Eduardo R. Latour of Latour & Associates PA in Tarpon Springs.
