Apopka couple alleges insurer failed to pay for property damage

ORLANDO — Apopka property owners are suing an insurance company, alleging breach of contract.

Rudy and Jennifer Callahan filed a complaint Feb. 2 in Orange County Circuit Court against Universal Insurance Company of North America, alleging the defendant refused to cover the full property damage to the plaintiffs' residence as agreed to in the insurance contract.

According to the complaint, on April 4, 2017, the Callahans'  property at 935 Oasis Court, Apopka suffered severe weather event damage. The suit says the Callahans gave proper notice to Universal in order to receive insurance coverage. 

Despite performing all conditions precedent to entitle them for adequate compensation, the plaintiffs allege they were denied coverage and refused to be given payment in compliance with the insurance coverage. 

The plaintiffs allege Universal Insurance of North America failed and refused to cover the full property damages and has denied and failed to pay for the roof replacement.

The Callahans seek trial by jury, property damages of more than $15,000 for personal property, and/or loss of use, plus prejudgment interest, court costs and attorney fees. They are represented by attorney Steven M. Johnson of Johnson & Williams PA in Orlando.
