Customer alleges credit union of violating FCCPA

ORLANDO — A Florida woman is suing a credit union, alleging violation of the Florida Consumer Collection Practices Act (FCCPA).

Sarah White filed a complaint Feb. 2 in Orange County Circuit Court against Space Coast Credit Union, alleging unfair practices in trying to repossess the plaintiff's motor vehicle.

According to the complaint, on Oct. 1, 2010, White purchased a new 2011 Kia Soul from City Kia in Orlando that was financed through a loan from Space Coast Credit. The suit says since December 2017, White she has suffered damages, including anger, anxiety, emotional distress, fear, frustration, upset, humiliation and embarrassment, as well as suffering from abusive invasions of personal privacy and wasted time because the defendant repossessed her fully paid for vehicle without any notice and attempted to collect an improper debt. 

The plaintiff alleges Space Coast Credit Union threatened to enforce an illegitimate debt, and took possession of White's property despite its prior confirmation of full payment and release of title to the plaintiff.

White seeks trial by jury, damages, statutory damages of $1,000, costs of litigation, attorney fees,and all other relief the court deems just. She is represented by attorney Max Story of Jacksonville Beach.
