Motor vehicle passenger alleges insurer failed to cover crash damages

ORLANDO — A motor vehicle passenger is suing State Farm Insurance, alleging breach of contract.

Angel Guzman of Orange County filed a complaint Feb. 2 in Orange County Circuit Court against State Farm Mutual Automobile Insurance Company, alleging the insurer failed to pay for the injuries she suffered in a vehicle crash. 

According to the complaint, on Nov. 18, 2015, Guzman was a passenger of a 2014 Toyota Tundra that was exiting northbound off Interstate Highway 95 and was stopped at state Road 798 for a red light. The suit says a 2002 Toyota Camry driven by Carline Benet, an underinsured motorist, violently rear-ended the vehicle the plaintiff was in.

Guzman says she suffered bodily injuries and incurred medical expenses. However, she alleges State Farm refuses to provide uninsured/underinsured benefits due to her according to the law. The plaintiff alleges State Farm has failed to pay Guzman's covered losses and failed to provide proof to establish that the insurer is not responsible for those payments.

Guzman seeks trial by jury, damages in excess of $15,000, exclusive of interest, court costs and attorney fees. She is represented by attorney Don Mathews of Don Mathews & Associates PA in Fort Myers.
