ORLANDO — A business invitee is suing Lakeside at Winter Park LLC and Radco Management Inc., property manager, citing alleged negligence.
Robert Fiedler filed a complaint on Feb. 2, in the Orange Circuit Court against the defendants alleging that they failed to provide a safe environment for their business invitees.
According to the complaint, the plaintiff alleges that on Nov. 20, 2016, while he was lawfully on defendant’s premises as a business invitee, he tripped on a staircase in a dark area without illuminating or operational lights, and as a consequence he fell forcefully to the ground and sustained severe bodily injury, disability, disfigurement, scaring, mental anguish, loss of earnings and aggravation of previous existing conditions.
The plaintiff holds Lakeside at Winter Park LLC and Radco Management Inc. responsible because the defendants allegedly failed to maintain or adequately maintain the lighting in stairwells, failed to adequately inspect the lighting system and failed to warn plaintiff of the danger of the staircases.
The plaintiff requests a trial by jury and seeks judgment against defendant in excess of $15,000, plus interest and costs. He is represented by Jason P. Herman of Dan Newlin & Partners in Orlando.
