Florida resident claims insurance carrier breached contract

ORLANDO — A Florida resident is suing Security First Insurance Company, an insurance carrier, citing alleged breach of contract.

Evelyn Montalvo filed a complaint on Feb. 2 in the Orange Circuit Court against Security First Insurance Company alleging that the insurance carrier breached its duty of good faith and fair dealing.

According to the complaint, Montalvo alleges that on Sept. 11, 2017, her property suffered severe damage due to Hurricane Irma. Although the defendant has admitted that the loss is covered and has made a partial payment under the policy, the partial payment was not enough to cover all the damages sustained by the property. 

The plaintiff holds Security First Insurance Company responsible because the defendant allegedly failed and refused to provide plaintiff with full coverage for the remainder of damages stemming from the covered loss.

The plaintiff requests a trial by jury and seeks judgment for damages against defendant for breach of the contract, for any additional relief as permitted by law and as the Court deems appropriate, including interest, costs, attorney’s fees, and all equitable remedies or other relief that may be appropriate.
