Cyclist blames bike manufacturer for fall, injuries

CLEARWATER — A Pinellas County woman resident is suing a bicycle distributor and manufacturer, alleging breach of implied warranty, breach of express warranty, negligence and strict liability.

Jacqueline Boyd filed a complaint Feb. 5 in Pinellas Circuit Court against Chainwheel Drive Inc. and Raleigh North America, alleging they obtained profit through distribution of a substandard product that caused her injuries.

According to the complaint, on Jan. 29, 2017, Boyd was riding her Raleigh bicycle in Palm Harbor when the front wheel deflector became partially detached, causing the front wheel to lock up and causing Boyd to be thrown off her bike and onto her right side. The suit says she  suffered injuries to her head, neck, body and limbs, and sustained pain and suffering, disability, mental anguish, disfigurement, loss of earnings, and aggravation of previous existing condition. 

The plaintiff alleges the defendants failed to conduct adequate testing to discover defects on the bicycle, and failed to warn Boyd she had purchased a defective bicycle.

Boyd seeks trial by jury, damages in excess of $15,000, plus attorney fees, court costs, interest and all other relief the court deems just. She is represented by attorney Joshua T. Chilson of Johnson, Pope, Bokor, Ruppel & Burns LLP in Clearwater.
