Estate representative says medical providers were negligent

ORLANDO — A representative is suing Avante at Orlando Inc. and AG Holdings Inc., Avante Group Inc. and Eric L. Mock, nursing home operator, citing alleged breach of duty, negligence, and wrongful discharge.

Melida Arroyo, representing the estate of Martha Yolanda Suero de Volquez, filed a complaint on Feb. 1 in the Orange Circuit Court against the defendants, alleging that they failed to exercise standard care and skill required of medical facilities.

According to the complaint, Suero de Volquez suffered damages and eventually her untimely death as a result of the defendants' reckless disregard for the health, safety and rights of its residents, including the lack of staff and inadequate care and treatment. 

The plaintiff holds the defendants responsible because they allegedly failed to protect Suero de Volquez from dangerous conditions within the facility, failed to use her assets for the necessities required for her support and maintenance, and failed to monitor her significant signs and symptoms of infection and deterioration.

The plaintiff requests a trial by jury and seeks judgment against defendants, disgorgement of profits, consequential damages,attorneys' fees and costs, interest, punitive damages, and other relief the court deems appropriate. She is represented by Dara A. Cooley of Wilkes & McHugh PA in Tampa.
