Orlando property owners allege insurer failed to cover hurricane damage

ORLANDO — Orlando property owners are suing an insurance company, alleging breach of contract.

Sylvia Arce and Maria Arce filed a complaint Feb. 1 in Orange County Circuit Court against Safe Harbor Insurance Company, alleging the defendant refused to pay the full amount of insurance proceeds due from hurricane damage.

According to the complaint, on Sept, 11, 2017, while their insurance policy with Safe Harbor was in full force and effect, the Arces' property at 1050 Palos Verde Drive, Orlando, suffered a loss due to damage from Hurricane Irma. 

The Arces believe the loss is covered under the policy but says Safe Harbor neither acknowledged coverage nor denied coverage in writing and has apparently taken the position that it has no specific time or duty within which it is to perform its obligation to adjust the loss. 

The plaintiffs allege Safe Harbor Insurance has failed to provide any written acknowledgment of coverage or denial of the claims and failed to provide insurance proceeds as agreed in the contract.

The Arces seek trial by jury, damages in excess of $15,000, plus statutory interest, court costs and all reasonable attorney fees. They are represented by attorney David A. Gongora of Law Office of David D. Gongora,PA in Orlando.
