ORLANDO — A Florida couple is suing an insurance carrier, alleging breach of contract.

Jose and Laura Aponte filed a complaint Jan. 25 in Orange County Circuit Court against American Integrity Insurance Company of Florida, alleging failure to cover damage from Hurricane Irma. 

According to the complaint, on Sept. 10, 2017, while the Apontes' insurance was in full force and effect, their home sustained covered damages caused by Hurricane Irma. Although the plaintiffs say they have complied with all conditions to entitle them to recover payments under the policy, American Integrity has refused to pay for the covered losses. 

The plaintiffs allege American Integrity Insurance of Florida has failed to replace and/or repair the Apontes' roof and interior damage, and failed to pay the statutory interest penalties and attorney fees required by law.

The Apontes seek trial by jury, damages for more than $15,000 for all covered losses with interest on any overdue payments, plus attorney fees and court costs. They are represented by attorney Paul C. Perkins Jr., of Paul & Perkins PA in Maitland.
